These Terms & Conditions govern the sale of products through coldclothingstore.com. They form a legally binding agreement between you (the buyer) and Cold Clothing Store (the seller) under the Indian Contract Act, 1872, the Sale of Goods Act, 1930, the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020.

By placing an order on this website, you confirm that you have read, understood, and agreed to these Terms & Conditions.

1. Who We Are

Cold Clothing Store is an unregistered sole proprietorship operating an online retail business at coldclothingstore.com.

2. Products

2.1 Product Descriptions

We make every reasonable effort to describe our products accurately, including images, colours, sizes, and materials. However:

  • Product images are for illustrative purposes. Actual colours may vary slightly due to your device's screen calibration.
  • Size measurements are approximate. We recommend checking the size chart on each product page before ordering.
  • We reserve the right to change product specifications, discontinue products, or change branding or packaging without notice.

2.2 Product Availability

All products are subject to availability. We do not guarantee that any product listed on the website is in stock at the time of your order. If a product you have ordered is out of stock after payment, we will notify you and offer either a full refund or an equivalent replacement at your choice.

2.3 Sizing and Fit

Clothing is subject to personal fit preferences. We do not accept returns or exchanges solely on the basis that a product does not fit as expected, unless the product delivered does not match the size labelled. Please refer to our Return Policy for full details.

3. Pricing

  • All prices are listed in Indian Rupees (INR).
  • Prices are subject to change at any time without prior notice. The price at the time you complete checkout is the price you will be charged.
  • Shipping charges are calculated at checkout based on your delivery location and order value. See Section 6 for details.
  • We are not currently GST registered. No GST is charged on your order.
  • In the event of a pricing error on the website, we reserve the right to cancel your order and issue a full refund, even after payment has been received.

4. Placing an Order

4.1 How to Order

To place an order, add your chosen products to the cart, proceed to checkout, enter your delivery details, and complete payment through Razorpay. You will receive an order confirmation email once your order is successfully placed.

4.2 When a Contract Is Formed

An order placed on our website is an offer to purchase. A binding contract between you and Cold Clothing Store is formed only when we confirm your order and dispatch the item(s). The order confirmation email we send is an acknowledgement of receipt, not an acceptance of your offer.

We reserve the right to reject or cancel any order at our sole discretion before dispatch, including but not limited to cases where:

  • The product is out of stock.
  • There is a pricing or description error.
  • Payment cannot be verified or has failed.
  • The order appears fraudulent or abusive.
  • The delivery address is outside our serviceable area.

If we cancel your order after payment, a full refund will be issued within 5–7 business days.

4.3 Order Accuracy

You are responsible for ensuring that all details entered during checkout — including your name, delivery address, phone number, and selected product size or variant — are accurate. Cold Clothing Store is not liable for failed or delayed deliveries caused by incorrect information provided at checkout.

5. Payment

  • All payments are processed securely by Razorpay Software Private Limited. We accept UPI, credit cards, debit cards, net banking, and mobile wallets.
  • Cold Clothing Store does not store your card, bank account, or UPI credentials. All payment data is handled by Razorpay in compliance with PCI-DSS standards.
  • Your order is confirmed only after successful payment authorisation by Razorpay. If your payment fails, your order will not be placed.
  • Cold Clothing Store is not responsible for any additional charges levied by your bank or payment provider (e.g. transaction fees, foreign currency conversion).
  • In the event of a duplicate charge or erroneous deduction, contact us at ad min.coldclothingstore@gmail.com within 7 days and we will investigate and resolve the issue promptly.

6. Shipping and Delivery

6.1 Delivery Area

We currently ship to addresses across India only. We do not ship internationally.

6.2 Shipping Charges

  • Within Kerala: ₹49 per order.
  • Outside Kerala (rest of India): ₹99 per order.
  • Free delivery on orders with a cart value of ₹999 or above.
  • Store Pickup: ₹0. Available for customers who prefer to collect their order in person.

6.3 Delivery Timeframes

Delivery timeframes are estimates only and are not guaranteed. Delays may occur due to courier issues, weather conditions, public holidays, or circumstances beyond our control. Cold Clothing Store is not liable for delays caused by third-party couriers once the order has been dispatched.

6.4 Delivery Attempts and Failed Delivery

If a delivery attempt fails because no one is available to receive the order, the courier may re-attempt delivery or hold the parcel at a nearby facility. If a parcel is returned to us due to failed delivery caused by an incorrect address or repeated failed attempts, we will contact you to arrange re-delivery. Re-delivery charges may apply.

6.5 Ownership and Risk

Ownership of goods and risk of loss pass to you upon successful delivery to the address provided at checkout.

7. Cancellations

7.1 Cancellation by You

You may cancel your order before it is dispatched by contacting us at admin.coldclothingstore@gmail.com as soon as possible. Once an order has been dispatched, it cannot be cancelled — you may instead initiate a return after delivery.

If your cancellation request is received and processed before dispatch, a full refund will be issued within 5–7 business days to your original payment method.

7.2 Cancellation by Us

We reserve the right to cancel any order at any time before dispatch. If we cancel your order, you will be notified by email and a full refund will be issued within 5–7 business days.

8. Returns and Refunds

We accept returns for eligible products within a specified window from the date of delivery. Returns are subject to the conditions and process set out in our Return Policy and Refund Policy.

Key points:

  • Items must be unused, unwashed, and in original condition with all tags attached.
  • Returns are not accepted for items that have been worn, washed, or damaged after delivery.
  • Refunds are issued to the original payment method after the returned item is received and inspected.
  • Shipping costs are non-refundable unless the return is due to our error (wrong item, defective product).

9. Defective or Wrong Items

If you receive a product that is defective, damaged in transit, or different from what you ordered, you must notify us within 48 hours of delivery at admin.coldclothingstore@gmail.com with your order number and clear photographs of the issue.

We will, at our discretion:

  • Replace the item at no additional cost, or
  • Issue a full refund including return shipping costs.

Claims made after 48 hours of delivery may not be accepted unless the defect was not reasonably discoverable on receipt.

10. Consumer Rights

Nothing in these Terms & Conditions limits or excludes any right you have as a consumer under the Consumer Protection Act, 2019 or any other applicable Indian law that cannot be contractually excluded. Your statutory rights remain unaffected.

If you have a consumer complaint that we have not resolved to your satisfaction, you may approach the District Consumer Disputes Redressal Commission in your district or file a complaint at the National Consumer Helpline (1800-11-4000).

11. Intellectual Property

All content on this website — including the Cold Clothing Store name, logo, product images, and written content — is owned by or licensed to Cold Clothing Store. You may not use, reproduce, or distribute any of this content without our prior written permission.

Products sold on this website may carry third-party brand names and trademarks. Those trademarks remain the property of their respective owners. Cold Clothing Store makes no claim to those trademarks.

12. Limitation of Liability

To the maximum extent permitted by law, Cold Clothing Store's total liability to you in connection with any order or these Terms & Conditions shall not exceed the amount you paid for the specific order giving rise to the claim.

We are not liable for:

  • Indirect, consequential, or incidental losses.
  • Losses arising from courier delays or failures.
  • Losses arising from Razorpay payment processing failures.
  • Any loss that was not foreseeable at the time you placed your order.

13. Governing Law and Disputes

These Terms & Conditions are governed by the laws of India. Any dispute arising from these terms or any transaction on this website shall be subject to the exclusive jurisdiction of the courts at Kochi, Kerala, India.

Before initiating legal action, we request that you contact us at admin.coldclo thingstore@gmail.com to attempt an informal resolution.

14. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time. Changes take effect immediately upon posting with a revised "Last Updated" date. Your continued use of the website or placement of an order after any change constitutes acceptance of the updated terms.
